Terms & Conditions:
Important Notice:
By the conditions set out below the service provider
endeavours to forward to destination, through consolidation services any items
entrusted to it.
Definitions:
In these Terms & Conditions the following expressions
shall have the meaning set forth hereunder:
You Shop…we ship!™ (YSWS) shall mean the forwarding and/or
courier service provider in question.
“Consignment” shall mean any package, parcel or number of parcels addressed
to a single address sent at any one time and the contents thereof.
"Customer" shall mean the individual or company who
adheres to the foregoing conditions
"Money" shall mean coins, currency, money orders,
stamps, cheques of any type, bills of exchange.
"Jewellery" shall mean gold, silver, platinum,
diamonds, precious metal, carbons or stones (whether manufactured or in raw
state), watches, fine art or works of art.
Packaging:
All items shall be adequately packed as a protection
against damage in the course of transportation and in particular:
§
i. An item which is of a fragile
nature shall be packed in a container of sufficient strength and shall be
surrounded in the container with sufficient and suitable material against the
effect of such concussions, handling pressures to which the items are ordinarily
exposed to during transportation. The item shall bear the words
'FRAGILE HANDLE WITH CARE" written conspicuously in capital letters on
the face of the cover above the address.
§
ii. An item which is liable to be
damaged by bending shall be placed in a container of sufficient strength to
prevent the item from bending during transportation, and the item shall bear the
words
"DO NOT BEND" written
conspicuously in capital letters on the face of the cover above.
§
iii. Every item should be made up and
secured in such a manner to prevent the loss of contents as well as to prevent
damage to any other item/s.
§
iv. Soft items, like small items of
clothing, should be packed in padded envelopes or what are commonly known as
Jiffy Bags.
§
v. Solid or breakable items purchased
in their own custom-made boxes should simply be wrapped in thick wrapping paper
and then tied securely with strong string or twine. Tape is also acceptable as
long as this is restricted to edges or corners. Tape should never cover the
whole surface area of a parcel.
§
vi. In instances where the items
being dispatched do not have their own box, an alternative should be found
closest in size to the item being dispatched. The YSWS service provider reserves
the right to pack the item/s in question at an additional cost.
§
vii. Dangerous, hazardous or
prohibited items shall be refused if tendered for transportation, or if detected
in transit will be detained and treated in accordance with the legislation of
the country. The purchaser of such items shall be held liable for the removal
and the recovery costs incurred in its disposal.
§
viii. Items containing non-hazardous
liquids shall be packed in a container of sufficient strength and shall be
surrounded in the container with suitable material against breakages. The
purchaser will be liable to pay costs for accompanying items which might be
soiled or damaged as a consequence of inadequate packaging.
Method of address:
Every item should be legibly addressed and according to
the delivery instructions provided on the ‘Send on Locations’ tab. The YSWS service provider
shall not be held responsible or liable for incorrect deliveries due to wrong
addresses or for non-delivery of unnamed consignments.
The sender address must also be clearly written on the
package.
Hubbing & Consolidation Facilities:
The choice of location/s shall lie with the YSWS service
provider.
In the course of the provision of hubbing & consolidation
facilities, the service provider shall exercise the duty of care of a Bonus
Paterfamilias.
Liabilities & Limitation of Liabilities:
The YSWS service provider shall not be liable for any
direct, indirect or consequential loss or damage as follows:
§
a) caused by failure to perform any
of its obligations if such failure is the result of circumstances outside its
control;
§
b) arising from insufficient or
improper packaging or addressing;
§
c) caused to items containing
articles of a prohibited nature.
§
d) arising from failure by the
addressee to take delivery within a reasonable time;
§
e) arising from delay or seizure of
the item/s by any Official Authorities because of incorrect, insufficient,
incomplete or improper documentation. The Customer is responsible for ensuring
that the correct and the complete documentation required by any Official
Authority and/or any recognized Security Organisation is securely attached to
the outside of the item and acknowledges that the YSWS service provider is not
responsible for the presentation of this documentation to the concerned
authorities. The customer shall be held liable for any fees, costs, or losses
incurred due to submission of unacceptable & false documentation;
§
f) arising from failure by the sender
to place a documented claim / enquiry of non-receipt of the item, by the
addressee, after the lapse of three (3) months from the date of dispatch.
§
g) if the consignee would have not
registered the consignment through a booking form on this site and would
not have verified the receipt of and acknowledgement for same.
Delivery of Items:
Delivery of item/s to our overseas Send on Locations & consolidation
facilities including local deliveries to customers are affected during normal
working days and office hours excluding weekends and public holidays. Deliveries
affected outside normal business hours are subject to an additional cost.
Deliveries to Gozo are also subject to an additional delivery surcharge.
Payment for Services:
The shipping and/or courier fees in question are to be
paid by the customer upon the receipt of the said item/s.
Delivery/Non Delivery
Times are estimated and are not guaranteed. Delivery shall
be deemed to have been effected when the item/s is handed over to the intended
recipient/s or any other person/s acting on their behalf.
Customers are to note that our delivery agents shall not
wait for them to open the package/s containing the item/s but just deliver to
the indicated address.
Please note that any package that is
received at our Malta facility without a booking form is subject to a storage
charge. The YSWS help desk will endeavour to contact the recipient. Any package not claimed will be
disposed of after 31 days in storage.
Disclosure of Information:
All data & information provided to the YSWS service
provider by visitors to these web pages is considered to be confidential and
will not be disclosed to any third parties except as may be required for the
provision of the YSWS service.
